ESIC Maternity Leave Salary Procedure, Calculation & Eligibility

What is ESIC maternity leave: Women employees whose monthly gross salary is less than 21,000 Rs can get maternity leave salary up to 26 weeks. Insured women will get this maternity leave amount under ESIC maternity benefits.

Women employees whose monthly gross salary is more than 21000 Rs will get maternity leave amount for 26 weeks from their employer under the maternity benefits act 1961.

How To Claim ESI Maternity Benefit

  • Whenever pregnancy confirms for a woman employee, then before 8 weeks from the date of delivery they can start taking maternity leaves. And they can continue maternity leaves up to 18 weeks after the delivery date. (Maternity leaves can be availed in 8 weeks:18 weeks ratio)
  • So before taking maternity leave visit your ESIC dispensary and take a medical certificate from them regarding pregnancy.
  • Now submit ESIC self declaration form to ESIC office through your employer.
  • Now after completing the remaining 18 weeks of maternity leave submit maternity claim form 19 to ESIC office along with supporting documents like medical bills and follow the further instructions given by ESIC officials.

Eligibility For ESIC Maternity Claim Benefit

  • Insured woman should have a minimum of 9 months service and 80 days of contribution towards ESIC in between April to September or October to March. (9 months service means the total working period with the present employer and 80 days contribution means, ESIC member has to pay ESIC contribution for at least 80 days)
  • Insured woman can check their eligibility for ESIC maternity claim at ESIC IP portal.
  • To check ESIC maternity claim eligibility go to ESIC IP portal and enter your ESI number and captcha appearing on the screen. (Use Internet Explorer or Mozilla Firefox as browsers)

ESI Maternity Leave Salary Calculation:

There is no separate calculation for ESIC maternity claim, insured women can get complete salary including basic wage, DA, HRA, and incentive bonus. But they can’t get gratuity amount, bonus amount, PF, and pension contributions for that particular maternity leave period.

    my name is Dimpal Badhe and my husband name is Ojas Phalak .can i want to need change of surname?… because on my adhar card is with my name …don’t want to change my adhar card after marriage so is it possible for esic benefit?

    • Write a request letter to your ESIC office, and get it signed by your employer with an official stamp.
      And submit that letter to your ESIC office, then the sur name will be corrected.

    I have applied for a maternity leave salary but I have not yet received a salary for the maternity leave. I have started working after maternity leave. Due to child responsibility & travel restrictions due to covid, it is becoming difficult for me to continue working. I want to know if stop going to a job still will I get maternity leave salary which I have already applied for? or do I have to stick to my job till I get my maternity leave salary from ESIC?
    please guide.

    • If you are eligible for maternity leave and already applied for it then you have to contact your ESIC dispensary to know why the amount is not credited yet.
      Once you get the confirmation then you can leave your job.

    • Kindly provide Bank Passbook to employer to update at esic portal.

      You should reach HR/Employer to avail benefit hence they are the coordinator.

  6. I am on the job of joining from 1 May 2018, my salary 15000 and on maternity leave from July 2020. I have completed all the processes of leave from esi. Will I get salary if I am unable to continue my job again? plz suggest

    my name is saraswati samal i am current employee i titan eye plus under franchise , since more than 1 year , i had joined 12/july/2018 but they did deducted ESI. they started esi may 25th 2019
    now i am 7 month pregnancy. n my delivery date 12/10/2019.. already i have existing esi card from 2011 to 2015 but that card nothing showed they do a new card wht can i do pls give me suggestion am i eligibility for esi maternity leave or not

    • Hi Sangeetha, You have to submit maternity claim form 19 before or after the delivery date, but before that, you have to visit your ESIC dispensary and intimated them.

    • Hi Monika,
      If you have more than 80 days contribution towards ESIC then you are eligible for ESIC maternity leave. You should contact your employer to know how to claim it. If you are not under ESIC scheme (i.e if you monthly gross salary is more than 21000 Rs)then your employer has to pay the maternity leave benefits for 26 weeks.
