At present, the tax-free ceiling limit for gratuity amount underpayment of gratuity act 1972 is 10 lakhs, but after implementation of 7th central pay commission the gratuity limit for central government employees under Central Civil Services pension rules 1972 has been increased to 20 lakhs. Along with inflation, this is also one of the main reason behind the idea of government to implement the gratuity 20 lakhs notification for remaining public sector and private sector employees.

The main aim of gratuity act is to provide social security to the employees after their retirement, it may be due to the superannuation or physical disablement. Any organization which employs 10 or more than 10 employees will come underpayment of gratuity act 1972. Any employee who has 5 years of continuous service in an organization will be eligible for gratuity.

This bill also made a provision to consider the maternity leaves of women employees as a continuous service. Till now only 12 weeks of maternity leaves are considering as continuous service of gratuity but in last year the maternity leaves were increased to 26 weeks. As per this bill, the maternity leaves of more than 12 weeks will also be considered as continuous service under gratuity. Do share your opinions and doubts on gratuity 20 lakhs notification.

  1. Sir I had served 43years service in Karnataka state Minerals Corporation Limited ( Undertaking Govt.) The management has paid only 42 years Gratuity of 16.00lakhs. they said not elegeble for 43rd year as per KCSR Rules. please clarify Management has utlised my service of 43years yhey should give 43years Gratuity or 20.00 lakhs celling . please give clarification i have elegeble for 43rd year Gratuity with kind regards

    I was retired on 31 Dec.2015 from central government after 35 years of service.Can I get enhanced gratuty as per 7th pay commission.

  3. it should be 01.01.16 as applicable to central govt. employees, why govt is discriminating psu and bank employees from center. psu and bank employees are also govt. employees, they should also get enhanced gratuity at par with other employees. what is their fault if they retired or died during 16–17 and govt could not pass the bill in parliament on time. ???

  4. As earliar our pm declared effective date 1.1.2016.accordingly they should get 20 lacs.there should not be involvement of judiciary.otherwise it will take years to get it

    I have retired from SBI on 31/01/2018 as Deputy Manager after completion of 37 years service.Can I eligible for enhance gratuity of 20 lakh.

    • Tanmoy ji, You are eligible for gratuity of Rs.10 lakhs vide amendment dt. 25-5-2010.
      It was raised to rs.25 lakhs from 29-3-2018. So bad luck, you missed it by a whisker.
